Healthcare & HIPAA-Adjacent Disclaimer (No PHI on Public Website)

DHWI provides advisory and consulting services related to healthcare operations, workflows, and digital transformation. The Website is not intended to collect Protected Health Information (“PHI”), and you agree not to submit PHI through public Website forms, scheduling notes, or email. If PHI is exchanged within a formal client engagement, it will be governed by separate written agreements (e.g., Business Associate Agreements) and handled through secure systems outside this Website.

Educational and Informational Purposes Only

The content and resources on this Website are provided for educational and informational purposes and are not legal, medical, compliance, tax, or financial advice. You are responsible for obtaining appropriate professional advice for your specific situation.

No Guarantees

We may share examples, case studies, or outcomes; however, results vary. We do not guarantee any specific outcomes, revenue, clinical results, operational performance, compliance status, or financial results from using the Website or Services.

Appointment Scheduling

The Website may allow you to request or schedule consultations. Appointment availability is not guaranteed. You are responsible for providing accurate contact information so we can confirm or communicate about your appointment. You agree not to include sensitive information (including PHI) in scheduling notes or free-text fields.

Permitted Use and Prohibited Use

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website for lawful purposes consistent with these Terms.

You agree not to:

·       Use the Website in any way that violates applicable laws or regulations.

·       Attempt to gain unauthorized access to the Website, systems, or data.

·       Interfere with, disrupt, or degrade the Website (including introducing malware).

·       Scrape, harvest, or collect information from the Website without permission.

·       Use our content to create competing products or services, or to resell/redistribute our resources without written permission.

Intellectual Property

All content on the Website, including text, graphics, logos, frameworks, training materials, templates, downloads, and other materials (the “Content”) is owned by DHWI or its licensors and protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.

You may not copy, reproduce, distribute, publish, create derivative works from, or commercially exploit any Content without our prior written consent, except for limited personal or internal business use where explicitly permitted.

Free Downloads and Resources

If we provide free downloadable resources in exchange for your contact information, those resources are licensed to you for personal or internal business use only. You may not resell, redistribute, or publicly share the resources without our written permission.

Purchases, Payments, and Refunds

At this time, the Website primarily offers consulting services and free resources. If we offer paid digital products, downloads, or courses in the future, additional purchase terms (including any refund policy) will be displayed at checkout or provided in a separate written agreement.

Client Engagements and Separate Agreements

Consulting services may be governed by a separate written agreement (e.g., proposal, statement of work, master services agreement). If there is a conflict between these Terms and a signed client agreement, the signed client agreement controls for that engagement.

User Submissions

If you submit feedback, testimonials, comments, or other materials (“Submissions”), you grant DHWI a non-exclusive, worldwide, royalty-free license to use, reproduce, and display those Submissions for business purposes (e.g., improving services, marketing), unless you explicitly request otherwise in writing.

Third-Party Links and Tools

The Website may include links to third-party websites or services. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

SMS/Text Messaging Terms (Transactional Only)

If you opt in to receive text messages from DHWI, the following SMS terms apply. At this time, DHWI uses SMS for non-marketing messages such as appointment reminders, consultation confirmations, and customer support or service updates.

You can cancel the SMS service at any time by texting "STOP" to the phone number used to send you messages. After you send "STOP," we will send a confirmation message and you will no longer receive SMS messages from us. If you want to rejoin, you can opt in again through our forms.

If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at [email protected].

Carriers are not liable for delayed or undelivered messages.

Message and data rates may apply for messages sent to you from us and to us from you. Message frequency may vary based on your appointment activity and support needs.

For privacy information related to SMS, please review our Privacy Policy at: https://DigitalHealthWorkflow.com/privacy-policy (or the applicable Privacy Policy link on the Website).
